Chilmark Board of Health Minutes
January 18, 2006

Attendees: Mike Renahan, Katie Carroll, Matthew Poole, Sylvia Yeomans, Reid Silva, Raymond Shea, Camille Shea

The Board approved minutes of January 4, 2006  as corrected.

Roland & Gertrude Shea (8-43) B At 6:10 PM this hearing was continued from December 14, 2005.  Raymond Shea reported that the Conservation Commission denied his application.  He informed the Board that he intends to appeal the decision and would like the Board of Health to continue the process of evaluating the disposal works application.  Mike Renahan informed Mr. Shea that it would be best if the Board of Health review the Conservation Commission decision prior to any Board of Health ruling.   Matt Poole encouraged Mr. Shea to look into alternative systems such as a composting toilet with a grey water system.  This hearing will be continued on February 15, 2006 at 6:10 PM.

John & Daphne Cunningham (1-9) B The Board approved this disposal works application
      The Board approved this well permit application.

The Board reviewed the final budget submitted to the Finance Committee.   For liability reasons, the Board decided that John Powers should be listed as the Town=s Assistant Septic Inspector.  Sylvia will make a formal request by sending  a memo to Tim Carroll.

Chilmark Landfill Violation Notice B Don Hatch informed the Chilmark Board of Health that the Refuse District is responsible for the inspections at the Chilmark Landfill.  He is in the process of getting the inspection done by Wright Pierce, and will forward a report to the Chilmark Board of Health.

Thomas Walsh (25-11) B The Board continued discussions regarding an enforcement letter.

June Wilson (30-47) B An as-built letter was received from John Powers.  The Board instructed Sylvia to obtain a letter and photos from Kent Healy on the portion he inspected.

The Board noted the following installer=s permit renewals:
Richard Olsen & Son, Inc.                       Kevin Peters & Son
White Bros.-Lynch Corp.                         John Keene Excavation, Inc.

Ethel=s Kitchen B The Board noted this residential kitchen food permit renewal.

The Home Port Restaurant B This septic inspection passed.  The Board requested the following; check the permitted seat count, and find out if there is a current maintenance contract.

Forbes Smiley (21-41) B The Board requested Sylvia research this septic construction permit.  We have no record that this septic system was inspected after installation.  Without a certificate of compliance, use of this system is in violation of the permit.

The Board asked if annual reports were received for all alternative systems that have maintenance agreements.
